Many of the defendants in sexual abuse litigation, including the Boy Scouts of America,  have opted to file for various types of bankruptcy to fight off pending lawsuits, including Chapter 11 bankruptcy.

It’s important to note because these defendants and or entities have declared “bankruptcy” that DOES NOT restrict sexual abuse victims from receiving compensation.  

The bankruptcy process is sometimes used to shelter organizations in the wake of massive litigation such as child sexual abuse. This does not mean individual victims can not receive compensation. In these types of bankruptcy settlements, a certain amount of money is set aside for the victims and their families.

For example, the Catholic Diocese of New Ulm in Minnesota recently reached an agreement on a $34 million dollar settlement for 100 victims of sexual abuse. ¹

These types of sexual abuse settlements are finally giving actual victims access to compensation which they have not had before.

Boy Scouts of America Sexual Abuse Settlement

• In February of 2020, the Boy Scouts of America filed for Chapter 11 bankruptcy.
• This bankruptcy filing was due to the increasing number of lawsuits from victims of childhood sexual abuse by the Boy Scouts.
• According to AP News “The Scouts resorted to Chapter 11 in hopes of surviving a barrage of lawsuits, many of them made possible by recent changes in state laws to allow people to sue over long-ago sexual abuse.” ²
• The Boy Scouts of America estimates over 5,000 victims will file a sexual abuse claim against the corporation.
• There are reports that the Boy Scouts of America have set aside $1 Billion dollars for this sexual abuse bankruptcy settlement. ³

There are currently no hard deadlines on this reported $1 billion dollar bankruptcy settlement. While there has been no “bar date” set for the Boy Scout Chapter 11 bankruptcy settlement, the window on filing these claims usually is between 3 to 5 months once announced. Catholic Diocese of New Ulm Minnesota Sex Abuse Settlement

In early March 2020, the Catholic Diocese of New Ulm, which is based in Minnesota, reached a  $34 million dollar settlement with under 100 victims of sexual abuse. This settlement is not closed to new claims, so if you were abused by a member of the Diocese of New Ulm, you made be entitled to compensation. During a public apology after the announcement of the settlement, Bishop John LeVoir stated: “We should have taken responsibility and shared the truth on our own“. ⁴

Roman Catholic Diocese Sex Abuse Bankruptcy Settlement

In February of 2020, the Roman Catholic Diocese in Pennslyvania filed for bankruptcy in the wake of hundreds of lawsuits being filed for sexual abuse. The diocese claims they have already settled with victims for $12 million dollars. However, new victims are reporting abuse from Roman Catholic Diocese members will drive that number higher. There is also pending litigation in Pennsylvania on the statute of limitations for these sexual abuse claims.
